Public Offer Agreement
PUBLIC OFFER AGREEMENT
for the provision of services by the Online Ustaz educational platform
Limited Liability Partnership «Online Ustaz» (BIN: 260340000302), hereinafter referred to as the «Platform», publishes this Public Offer Agreement addressed to any individual or legal entity (hereinafter — «User»).
This agreement constitutes a public offer in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan. Registration on the website onlineustaz.kz signifies full and unconditional acceptance of the terms of this Agreement.
1. Terms and Definitions
Platform — the Online Ustaz educational marketplace (onlineustaz.kz), connecting students and tutors.
Student — an individual registered on the Platform for the purpose of receiving educational services.
Teacher/Tutor — an individual or sole proprietor registered on the Platform for the purpose of providing educational services.
Lesson — an individual or group session with a tutor conducted through the Platform.
Course — educational material published by a Teacher on the Platform.
Test — a paid test or practice exam (including preparation for the UNT), purchased individually, as a package, or by subscription.
Wallet — the User's virtual balance on the Platform.
Cancellation Deadline — the latest time for cancelling a lesson, equal to the date and time of the lesson minus 24 hours.
2. Subject of the Agreement
2.1. The Platform provides Users with access to educational services: lessons with tutors, online courses, tests for UNT preparation, and other educational products.
2.2. The Platform acts as an intermediary between the Student and the Teacher and bears no responsibility for the content of educational materials created by Teachers.
2.3. Access to paid services is provided after payment in accordance with the terms of this Agreement.
3. Registration and Usage Procedure
3.1. Use of the Platform requires registration with accurate information.
3.2. The User is responsible for the security of their account credentials.
3.3. The Platform reserves the right to block an account in the event of a violation of the terms of this Agreement.
3.4. The User undertakes not to use the Platform for unlawful purposes.
4. Cost of Services and Payment Procedure
4.1. The cost of services is stated in tenge (KZT) on the pages of the respective courses, lessons, and tests.
4.2. Payment is made online through the FreedomPay payment service (LLP «FFIN Payments») using Visa and Mastercard bank cards, as well as Apple Pay and Google Pay.
4.3. The Platform does not store Users' bank card data. All payment transactions are processed by FreedomPay.
4.4. Upon successful payment, the User is granted access to the paid service.
5. Refund Policy
5.1. General Refund Rules
All FreedomPay payment system fees do not constitute income for the Platform. The Platform does not retain fees for its own benefit in the event of refunds.
The refund method depends on the date of payment:
- Within 7 days of payment: full refund (100%) to the bank card. No fee is charged.
- After 7 days of payment: refund to the Platform balance (wallet) minus the FreedomPay payment system fee (3.5%). This fee represents the actual costs incurred for processing the payment and does not constitute income for the Platform.
- When withdrawing funds from the Platform balance to a bank card, a FreedomPay fee of 1.9% (minimum 300 KZT) is charged. This fee is paid by the User and does not constitute income for the Platform.
5.2. Tutor Lesson
Lesson confirmation by the teacher:
- Standard booking (more than 24 hours before the lesson): the Teacher is required to confirm the lesson within 24 hours of booking.
- Urgent booking (less than 24 hours before the lesson): the Teacher is required to confirm the lesson within 1 hour of booking.
- If the Teacher fails to confirm the lesson within the specified time: the system automatically cancels the booking and the Student receives a 100% refund to their bank card.
Lesson cancellation by the Student:
- Cancellation before the deadline (24+ hours before the lesson): refund according to the rules of Section 5.1.
- Cancellation after the deadline or if the lesson has already taken place: no refund is issued.
Lesson cancellation due to the Teacher's fault:
- The Teacher cancelled the lesson after confirmation: the Student receives a 100% refund to their bank card regardless of the payment date. Fees (3.5% and 1.9%) are deducted from the Teacher's future payouts.
- The Teacher confirmed the lesson but did not conduct it (no-show): the Student receives a 100% refund to their bank card regardless of the payment date. Fees (3.5% and 1.9%) are deducted from the Teacher's future payouts.
What the Student sees at the time of purchase:
- If the lesson is more than 24 hours away — the cancellation deadline is displayed with the specific date and time.
- If the lesson is less than 24 hours away — a warning is displayed that the payment is non-refundable.
5.3. Course
A refund is possible if both of the following conditions are met simultaneously:
- No more than 14 days have passed since the purchase.
- Less than 20% of the course materials have been viewed.
If both conditions are met — refund according to the rules of Section 5.1.
If 20% or more of the course has been viewed, or more than 14 days have passed — no refund is issued.
5.4. Single Test
- The test has not been started (no question has been opened): refund according to the rules of Section 5.1.
- The test has been started (the first question has been opened): no refund is issued.
5.5. Test Package
- No test in the package has been started: refund according to the rules of Section 5.1.
- At least one test in the package has been started: no refund is issued for the entire package.
5.6. Test Subscription
- No refund is issued for the current billing period.
- The User may cancel the automatic renewal of the subscription at any time through their personal account.
- After cancelling automatic renewal, access to the subscription remains active until the end of the paid period.
Note: the test subscription feature will be available in future versions of the Platform.
6. Platform Commission
6.1. The Platform retains a commission of 10% from the amount of each transaction from the Teacher.
6.2. The Student pays the full cost of the service without additional Platform commissions.
6.3. All payment processing costs (acquiring) are borne by the Platform.
7. Liability of the Parties
7.1. The Platform bears no responsibility for the quality of educational services provided by Teachers.
7.2. In the event of a technical failure on the part of the Platform that deprives the User of access to a paid service, a full refund is issued.
7.3. The User is responsible for the accuracy of the data provided.
7.4. The Teacher is responsible for conducting confirmed lessons. In the event of a breach of obligations, fees are deducted from the Teacher's future payouts.
8. Personal Data
8.1. The Platform processes Users' personal data in accordance with the Privacy Policy published on the website onlineustaz.kz.
8.2. By registering on the Platform, the User consents to the processing of their personal data.
